Malpractice Insurance Guide
A practical guide to understanding, selecting, and securing malpractice coverage for your aesthetic practice.
Why This Matters: Malpractice insurance (professional liability insurance) protects you, your staff, and your medical director from claims arising from treatments. Most states require it, and your medical director agreement will typically require proof of coverage naming them as an insured party.
Types of Malpractice Coverage
| Type | What It Covers | Best For |
| Occurrence-Based | Covers incidents that occur during the policy period, regardless of when a claim is filed | Most clinics — provides ongoing protection even after policy ends |
| Claims-Made | Covers claims filed during the active policy period only | Lower initial premiums, but requires "tail coverage" if you switch or cancel |
| General Liability | Covers slip-and-fall, property damage, advertising injury — NOT treatment errors | Every business needs this in addition to malpractice |
| Product Liability | Covers adverse reactions to products you sell or use in treatments | Clinics selling skincare products or using injectables |
What Your Policy Should Cover
- Professional liability for all aesthetic services you offer
- Medical director named as additional insured
- All licensed practitioners and staff covered
- Adequate per-occurrence limit (typically $1M minimum)
- Adequate aggregate limit (typically $3M minimum)
- Coverage for laser/light-based treatments (if applicable)
- Coverage for injectables — Botox, fillers (if applicable)
- Coverage for IV therapy (if applicable)
- Tail coverage provisions (for claims-made policies)
- Defense costs included (not subtracted from limits)

How to Get Quotes
- Gather your info: Services offered, number of practitioners, annual revenue, claims history, state(s) of operation
- Contact 3-5 providers: Get quotes from both specialty and major carriers for comparison
- Ask about: What's excluded? Are lasers/injectables specifically covered? Is your medical director included?
- Review with your medical director: They may have requirements for minimum coverage limits
- Choose and bind: Once selected, get your Certificate of Insurance (COI) and send a copy to your medical director
Pro Tip: Many medical directors require seeing your COI (Certificate of Insurance) before signing your agreement. Having this ready speeds up your onboarding significantly.
Your Malpractice Readiness Checklist
- Researched at least 3 insurance providers
- Requested quotes with full service list
- Verified coverage includes all services I plan to offer
- Confirmed medical director can be named as additional insured
- Reviewed per-occurrence and aggregate limits
- Understand whether policy is occurrence or claims-made
- Asked about tail coverage (if claims-made)
- COI (Certificate of Insurance) obtained
- Copy of COI sent to medical director
- Policy renewal date noted in calendar
Important: Operating without malpractice insurance exposes you, your staff, and your supervising physician to personal liability. Most medical director agreements require proof of active coverage. Don't let this be the item that delays your launch.
