1. Service Description

Remote Medical Director provides medical director oversight, compliance support, and related administrative services for estheticians, med spas, wellness clinics, and related healthcare practices. Our Services include matching practices with licensed physicians who serve as medical directors, facilitating onboarding and documentation, and providing compliance infrastructure. We do not provide direct patient care, and our Services do not create a physician-patient relationship with your clients or patients.

2. Eligibility

To use our Services, you must be at least 18 years of age and have the legal authority to enter into a binding agreement on behalf of yourself or the business entity you represent. By using the Services, you represent and warrant that you meet these eligibility requirements.

3. Account Responsibilities

When you create an account or submit information through our platform, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update your information as needed.
  • Keep your login credentials confidential and not share them with unauthorized individuals.
  • Notify us immediately of any unauthorized access to or use of your account.
  • Accept responsibility for all activity that occurs under your account.

4. Compliance Obligations

Your Obligations: You are responsible for ensuring that your practice operates in compliance with all applicable federal, state, and local laws and regulations, including but not limited to scope of practice requirements, licensing, and insurance obligations. Remote Medical Director provides compliance guidance and infrastructure, but ultimate responsibility for lawful operation rests with you.

Our Obligations: We commit to matching your practice with appropriately licensed physicians, maintaining current documentation, and providing accurate regulatory guidance based on the information you provide to us. We maintain the confidentiality of your information in accordance with our Privacy Policy and applicable law.

5. Fees and Payment

Fees for our Services are determined based on your state of operation, number of locations, and services offered, as communicated during your consultation. Payment terms are specified in your individual service agreement. We reserve the right to modify our fee structure with reasonable advance notice. Failure to maintain timely payments may result in suspension or termination of Services.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Remote Medical Director, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Services. Our total liability to you for any claims arising under these Terms shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim. The information and guidance provided through our Services does not constitute medical advice, legal advice, or a guarantee of regulatory compliance.

7. Intellectual Property

All content, trademarks, logos, materials, software, and other intellectual property associated with the Services are the property of Remote Medical Director or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any of our intellectual property without our prior written consent.

8. Termination

Either party may terminate the service relationship in accordance with the terms of the applicable service agreement. We reserve the right to suspend or terminate your access to the Services immediately if you breach these Terms, provide false or misleading information, engage in conduct that we determine is harmful to our business or other users, or fail to maintain required payments. Upon termination, your right to use the Services ceases, though provisions that by their nature should survive termination (including limitation of liability, intellectual property, and governing law) will continue to apply.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or completely secure. 10. Governing Law and Dispute Resolution
